Terms of Use and Privacy

Vary is a video platform run by Bit (“we”, “us”). By watching, creating an account or uploading on Vary you agree to these terms. If you do not agree, please do not use Vary.

1. Using Vary and accounts

• Guests can watch videos without an account. Guests do not get a personalised feed, and cannot like, comment, follow or upload.
• Members must be 18 or older, or have a parent or guardian’s permission. Keep your password safe. You are responsible for what happens on your account.
• Individual and organisation accounts. Organisation accounts must be verified before they can upload. A verification badge confirms we have checked the account, not that we endorse its content.
• We may suspend or close accounts that break these terms or put others at risk.

2. Your content

• You keep ownership of what you upload or link. You give Vary a non-exclusive licence to host, stream, display, and promote it on Vary, including making copies needed to play it and, if you allow it, offline copies that members download for up to 90 days.
• Only upload or link videos you own or have permission to use. You are responsible for your content, including captions, titles and comments.
• Videos can be played from files you upload, from YouTube links, and from direct video or live-stream links. Linked videos remain subject to the terms of the site that hosts them.
• You can edit or delete your videos at any time. Deleting your account deletes your videos, comments and personal data (see section 7).

3. Copyright and takedowns

We respect creators’ rights. If you believe a video or comment infringes your copyright, use Report on that video and choose “Copyright infringement”, with your name, contact details and what was copied. We review reports, may remove the content while we look into it, and may remove repeat infringers. If your content is removed in error, tell us and we will take another look.

4. Rules

Do not post content that is unlawful, hateful, harassing, sexually exploitative, dangerous, deceptive or spam. Never post content that exploits or endangers children. Do not misuse Vary, try to break it, scrape it, or harm other members. Videos marked “made for kids” must be suitable for children. We may remove content, restrict features, or report unlawful content to the authorities.

5. Verification and Premium

• Verification and Premium may carry a fee, shown before you pay. At the moment you pay by M-Pesa and send us the transaction code; we approve once the payment is confirmed.
• Premium unlocks comprehensive analytics and other premium features, and runs for the period you paid for. Features may change over time.
• Fees are not refundable once the service has been provided, except where the law says otherwise.

6. Creator Programme and earnings

The Creator Programme offers perks to approved creators. Joining does not guarantee earnings. Revenue sharing is still being designed; we will explain the terms before anything becomes payable. We may change or end the programme.

7. Your data and privacy

We handle personal data under the Kenya Data Protection Act, 2019. Here is what we collect and why.

• Account data: name, email, account type, password (stored as a one-way hash), bio and your verification and plan status. Used to run your account.
• Activity: what you watch, how far you got, likes, dislikes, saves, comments, follows and interests. Used to personalise your feed (members only) and to let you continue where you stopped.
• Usage analytics (with your consent): watch time, completions, searches, device type, language, time zone and the country that goes with it, and your choices on the site. If you allow precise location, a rounded location (about one kilometre) is also recorded. Used to understand how Vary is used, improve it, show creators basic or premium analytics, and suggest videos near you. Guests’ activity is analysed but never used to personalise their feed.
• Feedback: ratings and comments you send us.
• Reports: reports you make and the details you give.

Consent and choices. We ask before collecting usage analytics. You can change your choice, turn precise location on or off, clear your history and taste profile, or delete your account in Settings at any time. Essential data needed to run the site (for example to keep you signed in) is not optional.

Cookies and storage. We use a sign-in cookie that lasts up to 90 days so you stay signed in, and a “remember me” token for the same purpose. Your browser also stores settings, watch progress and (if you choose) offline downloads on your device. Offline downloads are deleted after 90 days.

Sharing. We do not sell your data. It is processed by our hosting providers to run Vary. Creators see analytics about their own videos, not who you are. We may share information when the law requires it.

Retention and your rights. We keep data while your account is open and delete it when you delete your account, except where we must keep records by law. You may ask to see, correct or delete your data, object to processing or withdraw consent. You can also complain to the Office of the Data Protection Commissioner of Kenya.

8. Vary Kids

Vary Kids shows videos that creators have marked as made for children. Children can watch without an account. We do not run personalised recommendations on guest viewing. Parents and guardians are responsible for supervising children’s use. If you see something unsuitable, use Report so we can review it.

9. Live and offline features

Live streams are links to streams hosted elsewhere and play inside Vary. We cannot guarantee availability. Downloaded videos are for personal offline viewing and expire after 90 days.

10. Disclaimers and liability

Vary is provided “as is”. We do not promise it will always be available or error free. To the extent the law allows, Bit is not liable for losses arising from your use of Vary or from content posted by members.

11. Changes, law and contact

We may update these terms and will change the date above when we do. Continued use means you accept the update. These terms are governed by the laws of Kenya. Questions, requests about your data, or complaints: use the enquiry form on our home page or choose Feedback inside Vary.
